German Law/Death Certificate & Inheritance


Please assist with the following questions:

1. What is the legal requirements for death certificates in Germany? Does the deceased parents have to be listed?

2.As the legal heirs, can where can we request a statement / inventory of the deceased assets/ banking etc?

3. Is a government pension fund inherited by the heirs?

1. The names of the parents of the deceased are not indicated in a death certificate.

2. Since there is no probate proceeding in Germany there is no administrator appointed who would establish an estate inventory. This could be different if heirs are unknown and a curator has been appointed by the court to protect the estate until the heirs are found or if an executor has been named in the will. Otherwise, it is up to the heirs to take care for the estate themselves. Anyone who takes possession of the estate has to render account.

3. There is no share in a pension fund in Germany which could be subject to a succession. German state pension contributions and entitlements are based on a pay-as-you go scheme.
