Hi, My current partner has been living separately from his German wife for three years.He is in England and she in Germany. He returns to visit his six year old child and stays in the marital home about once every three months for up to a week.He is not a German by birth but holds a German passport as he entered Germany as a refugee.
If his wife were not to contest the divorce how long would the procedure take and how much would this be likely to cost. If she were not willing to grant him a divorce what would the situation be.
They are currently amicable regarding financial support of the child as it is understood by all that she earners much more than him and he contributes what he can and also pays to travel to see the child and remain in contact , however were the situation to be formalized by a divorce court what implications would this have financially ?

Dear Isis,
Your partner can get divorced in Germany and it does not matter if his wife agrees or not because they are separated for over one year. It normally takes about one year to get the divorce etc, finalized. Your partner would be obligated to pay the minimum child support (about 170 Euro per month).

Answer Dear Isis,
a divorce in Germany costs about $1600.00. It can be cheaper in the US but you need to get the papers translated and served according to the Den Hague Convention otherwise your partner's wife does not need to sign the papers.
