Question If the Guns are under my name, and forgot to get them out of house when moving out, guns were purchased on my personal card and registered to me - can I get them back %26 how would I go about it
Thanks
Tiffany
Answer Tiffany,
Depending on what state you live in, they may or may not be registered. Most states do not have gun registration. Many people mistake the transfer form they fill out when purchasing a firearm as a 'registration' but it is actually only a record of transfer.
As far as getting the guns back, you can certainly ask for them to be returned to you. If they were not listed as a part of the settlement agreement, you may have difficultly getting them back. As I understand it, anything that is not listed as part of the settlement is left to the parties to divide up. Your ex may or may not be willing to part with the guns.
If you do live somewhere that requires an Firearms Identification Card to purchase or possess a firearm (New Jersey or Illinois, for example), then you could reasonably claim the guns are yours. Again, if your ex isn't willing to part with them, you may have to get your lawyer involved or take him to small claims court to attempt to claim your property.
I know none of this is probably good news to you. If you can tell me where you live (city/state), I might be able to give you a few more specifics.
