Question Dear sir,
I have just joint a new company, and I am currently on my second probation month.
Unfortunately, I don't enjoy the job at all and thinking of quitting by the end of this month.
My questions are:
1. Since I am still on my probation month,I think a one-week notice will suffice. Am I correct legally?
2. The financial month in my company is counted from 26th of the previous month to the 25th of current month.Unfortunately, the salary will only be given on 1st of every month. Do you think that the employer can have a right to hold my salary due to my one-week notice?
3.I can't bear to stay even for another one week. Since I am still in my probation period, am I eligible to walk out from this office anytime(and still got my salary for the working time that I have served), as I know that in probation period, even the employer have the right to terminate me anytime?
Looking forward to your reply.
Thank you for your kind attention.
Best regards
Debbie
Answer Debbie-
Thanks for your question.
You have the right to leave any at any time - the consequences
may be another issue entirely. There is no legal issue in giving a one-week or two-week notice, it's more a matter of leaving on good terms and buring bridges. You probably won't get a good reference from this employer if you don't give adequate notice.
The matter of forfeited salary based on notice is a matter between you and this individual company. Talk to the HR department and they should give you some guidelines or it should be covered in your contract or employee manual.
Think long and hard about your situation. There is an old
adage which is absolutely true - it's always a lot easier to get a job if you've got a job.
