Question My 24 year old daughter has been living with her boyfriend from the honduras here in mt for over a year - they had a baby last August. His visa (or whatever) expired and he had to go back to the Honduras. She wants to go down there and marry him (I understand this marriage would be recognized by U.S.) and have him come back to Montana with her and her baby. Is this a valid option? Are there other more viable options available? Can their baby go with her on a passport without the father's consent? Thanks in advance. Rick

I'm not an expert in immigration laws but what here's what I know:
1. Yes, the marriage would be recognized by the US but the paperwork for the husband to become a citizen takes some time. My guess is between 1-2 years for him to be legal to enter the US as a citizen. I think that if he has a tourist visa he can always travel back and forth in the meantime. You need to check this with the Immigration office.
2. On the Honduran side the baby can leave the country with only one parent as long as they get a legal document in Honduras saying that the father allows the baby to travel. You would have to ask you immigration office about the baby leaving the US with only one parent.
