Human Resources - Earning Paid Time Off Upon Returning From Maternity Leave

Hi Mr. Ballas,

I recently returned from maternity leave and thought upon my return I would be entitled to earn paid time off. My employer told me that I was not entitled to earn any time off until next year because I am like a new employee. Can they do this? Normally, I would of been entitled to two weeks worth of vacation this calendar year but because I went on maternity leave, I am only given one week. Of course, to protect themselves, my company's employee handbook is so vague that all it says is that an employee is entitled to 2 weeks of vacation after a year of employment. Thanks so much for taking the time out to answer my question.

They can do this only if they do this to others who are out for similar or other medical reasons. There is a law called the Pregnancy Discrimination Act that protects employees from discrimination account their pregnancy.  Here is a link to info about the act.
