I have offices in U.S., Canada, UK, South Africa,Australia and NZ. I am most confident in the U.S. and Canadian but have knowledge of the internationals.
I do not have extensive knowledge of South Africa, Australia and New Zealand. I do have some Human Resource Knowledge in those areas.

I have worked in the Human Resources area with high emphasis on compensation and benefits for 25 years at the same company.
My company is an international company and I work with our International offices whenever there is a Human Resource area needing addressed.
I volunteer on the American Payroll Association hotline and have for the last 10 years or so. I answer many questions each week for other payroll and HR professionals, mostly on taxes, benefits and compensation issues.
I have been the trustee for our 401K plan for Retirement benefits and our 125 Cafeteria Plan for Health Insurance benefits.

Human Resources - Salaried Employee: Temp Pay Change to Hourly Rate

Question I have a manager who has submitted a request for a temporary change in compensation for one of his managers, due to change in this manager's duties and responsibilities for the next few months. Here is the situation:
"John Smith" is currently a Salaried employee making 75k/yr. Due to a special project and change in his duties and responsibilities, John's manager has submitted a pay request to HR as follows:
Requesting to change "John Smith" to $32.06/hr and any time worked over 40 hours, he should receive 1 1/2 times this rate. Note: All other Salaried benefits stay the same. This change will be in place until 1/15/2010.
Can HR approve this request? Is this legal according to Wage Regulations and FSLA rules?
Answer He is changing him to hourly for the time period of the special project. If he is doing different work and it is hourly than I don't see a problem with it. It is not illegal to pay anyone hourly even if they are exempt employees, the exempt is to exempt them from the FLSA and the overtime requirement.
Benefits are given to an employee by the company so the company may say what benefits an employee may have.
