I can answer questions pertaining to Compensation, Health Benefits, Retirement Plans, Payroll,Payroll taxes, Employee selection, Employee Termination, Training, and Employee Incentives. I have offices in U.S., Canada, UK, South Africa,Australia and NZ. I am most confident in the U.S. and Canadian but have knowledge of the internationals. I do not have extensive knowledge of South Africa, Australia and New Zealand. I do have some Human Resource Knowledge in those areas. I currently hold both the U.S. and Canadian Payroll Certifications. I currently hold the SHRM PHR certification. I have worked in the Human Resources area with high emphasis on compensation and benefits for 25 years at the same company. My company is an international company and I work with our International offices whenever there is a Human Resource area needing addressed. I volunteer on the American Payroll Association hotline and have for the last 10 years or so. I answer many questions each week for other payroll and HR professionals, mostly on taxes, benefits and compensation issues. I have been the trustee for our 401K plan for Retirement benefits and our 125 Cafeteria Plan for Health Insurance benefits.

Question
QUESTION: My firm recently tried to lay off an employee.  The next day she reached out to the appropriate parties and offered to "work for free" for 3 months while economic times are tough.  What are your thoughts on this?  There have been behavioral and performance issues with this employee in the past- but during the summer months there isn't much work going on so it might make sense to have a free resource.  Legally, how should we document this in the file- also- if someone is working for free- can they still be reprimanded like a "paid" employee?  Do we owe them anything (i.e. becoming part of staff again) after the 3 month window is up?

ANSWER: Pure..simple and to the point! It is illegal to allow an employee to work for free!!!!

QUESTION: They offered her health benefits and a metro card- does this count for anything?

Answer
The FLSA says that each employee must be paid for all the hours they work. They are not allowed to waive salary or overtime.

Insurance and a metro pass are fringe benefits and are not considered wages.

You would be in violation of the Federal Fair Labor Standards act if you are allowing an employee to work for free.
