Question QUESTION: My firm recently tried to lay off an employee. The next day she reached out to the appropriate parties and offered to "work for free" for 3 months while economic times are tough. What are your thoughts on this? There have been behavioral and performance issues with this employee in the past- but during the summer months there isn't much work going on so it might make sense to have a free resource. Legally, how should we document this in the file- also- if someone is working for free- can they still be reprimanded like a "paid" employee? Do we owe them anything (i.e. becoming part of staff again) after the 3 month window is up?
ANSWER: Pure..simple and to the point! It is illegal to allow an employee to work for free!!!!
Sorry but that is how it is.

QUESTION: They offered her health benefits and a metro card- does this count for anything?
Answer The FLSA says that each employee must be paid for all the hours they work. They are not allowed to waive salary or overtime.
Insurance and a metro pass are fringe benefits and are not considered wages.
You would be in violation of the Federal Fair Labor Standards act if you are allowing an employee to work for free.
