Question
Hi
I was planning to file my labor certification thru PERM.I was wondering if i can file I-140 and I-485 immediately after labor Approval or i have to wait for priority date?

Answer
Hi Deepak,

The I-140 can be filed immediately after labor approval, but whether I-485 can
be filed depends on whether you are from India or not, and whether the case
was filed in the EB-2 or EB-3 category. Further information on priority dates can
be found here: http://www.h1b1.com/visawaiting.htm
