Question
Hi,

My wife got her H1B before marrying.she has not yet travelled. I have a L1 visa. when i apply for L2 for her. is there any issue that she will lose her H1 B? if not can she transfer her  visa status to H1B after getting a job US?

Regards,
Reven

Answer
Reven,
Your wife can enter and maintain only one non-immigrant status at a time. So if she enters the US on L and wishes to change to H she would need to file for a fresh H-1B application. The good news is that she may be considered exempt from the H quota.
