Hi Robert,

I'm currently on H1-B visa from Company A, I'm planning to move to new company B, who agreed to sponsor Visa for me. If my visa transfer not approved by INS, can I still work for my current Employer "A" or will I be out of status?

Also, how soon can I start working for my new Employer "B", do I have to wait until the Visa transfer is approved, or can I start once I get the receipt notice? Also how fast the transfer process work, if it's filed under Premium processing?

If it gets denied you can stay working for A. You can start working ince the case is filed. Premium processing will get a response within 15 business days. If they ask for more info, they get another 15 days from when they receive the response.
