Immigration Issues/i-131 biometrics

Question
My mother filed I-131 1/18/08 online. She left US 1/19/08. We received INS I 797c, receipt notice of INS. Biometrics requirement becae effective 03/2008. Obviously she did not file with BIOMETRICS fee. INS currently processing 07/2007. How long could my mother still be out of the country. I read before a year she needs to comeback to retain the immigrant status and not 6 months?  As for approval for I-131 no guarantee that it will be answered on time before a year deadline. Are my info right. Can she stay still out of US before hitting the one year limit?

Your mother should not have left without an approval of the advanced parole.  This may may negatively impacted her adjustment of status application.  You need to consult with an attorney to see if her case can be fixed.
