Question
I am a U.S. citizen, and the guy I want to marry has 245(i) approved. His father applied for it and it was approved, and he was under 18 when it was approved, so he qualifies for it. If I marry him, can he get a status in the United States?

Answer
Hi,

Yes, since your fiance is grandfathered under sec. 245(i), if you marry each other than you can sponsor him and he can adjust status in the U.S.
