HELLO. MY HUSBAND RECEIVED 16 MONTHS IN STATE PRISON FOR PROB. VIOLATION AND 5TH DUI.WHERE CAN I CALL TO FIND OUT IF THERE IS A IMMIGRATION HOLD ON HIM. HE HAS A GREEN CARD. LIVES IN CA 19 YEARS. I AM A CITIZEN, SO ARE OUR TWO BOYS. MARRIED FIR 15 YEARS. IF THERE IS A HOLD CAN I FIGHT TO KEEP HIM HERE. PLEASE LET ME KNOW. TY

Hello Victoria:




If your husband is still detained, he may have an immigration detainer placed on him. Upon completion of his sentence, he will be transferred under the custody of ICE (Immigration and Customs Enforcement).
However, if he is currently out of detention, he may come under the authorities' radar following a simple traffic stop or violation. Following such arrest, he may placed in removal proceedings based on his criminal convictions.
There are legal relief available to him.  I need to know what his current status. Date of the conviction and resentencing?
