Question
my girlfriend entered USA from Colombia a few years ago on a fiancee visa. She married her US citizen fiance in Rhode Island within the 90 day period. Before their marriage interview at INS, they divorced. If she marries me here in Florida , as a US citizen can I file for her under a new adjustment of status package??

Hi,

Even though your fiance initially married the original sponsor of the fiance(e) petition within 90 days of her entry to the U.S., it does not appear that a new sponsorship package including adjustment of status through new marriage can be successfully filed since the divorce occurred prior to approval of adjustment of status application at marriage interview.
