Immigration Issues/H4 and L1 Visa

Question
Hi,
My wife holds H4 visa and L1 visa. She is now in US in her H4 Visa. If her employer wants her back to work in US in her L1 Visa, what should she do?

Thanks,
Ashwin Kollambalath

Answer
Hi,

She should depart the U.S. and enter using unexpired L1 visa stamp so that she is issued an I-94 at port-of-entry with L1 visa status.

Alternatively, her L1 employer can file a petition with the USCIS requesting change of status from H4 to L1.
