Immigration Issues/OPT

Question
Hello,

can I start my green card process from OPT w/o going through H1b? I am STEM and will be getting my OPT card soon and I thought of using it without going through the H1b hassle to get my green card.

Thanks

Answer
Hi,

As OPT is part of F1 student status, and as this status does not allow for intention to immigrate to the U.S., you should change to H1B status prior to start of green card process. H visa status is dual-intent, i.e., it is a nonimmigrant visa but it allows for intention to immigrate to the U.S.
