Question
Hi,
If someone wants to transfer his/her H1B visa to other employer,is there any minimum time duration attached to it?For example,if someone got his visa approved last week itself and want to switch the employer,do he/she needs to wait for a specific time period with current employer? And also visa can be done only if the yearly quota of the H1B is available?

Answer
Hi,

There is no minimum amount of time to be required with Employer A before Employer B can file an H1B petition. Employer B can file an H1B petition without the permission or knowledge of Employer A. There is also no limit to the number of employers that can file an H1B petition for an employee: www.h1b1.com/concurrent.htm

In addition, with respect to H1B extension (either through the same or different employers), visa cap is not applicable.
