Immigration Issues/PERM

Question
Hi, I'm currently holding H1B and on my 5th year. If my employer applies for my permanent resident card, does my employer need to get a new PERM labor certificate? Can we use what we used for my H1B application?

Answer
Hello,

Labor Certification (LC) should not be confused with Labor Condition Application (LCA). Labor Certification is for green card while Labor Condition Application is for getting H-1B visa. Your employer must get a PERM labor certificate.

Thank you for your attention. Best wishes.
