Immigration Issues/H1 Premium with H4/H4EAD Concurrent filing

Question
Hi All
Need guidance. I am currently on H1B and filed my H1extension in august under regular processing and it is still pending status.
I am also eligible for H4/H4EAD and want to file a COS application. If I file a new H4/H4EAD application, It will take 4-6 months now from what I am reading.

If I upgrade my H1 application to Premium, Can I attach H4/H4EAD application for me along with it? There are many cases online where people filed for their H1 Extension and attached H4/H4EAD getting a decision together. Not sure thosugh if I can do it for myself.  That way I might br able to get H4EAD much quicker which I need now as my H1B might be revoked soon.

Thanks in advance
Sidhu

Answer
Hi,

Your pending H1B petition can be converted to premium processing. However, an H4 (or H4/EAD) application cannot be filed along with the conversion request.

The USCIS will approve an H4 application via premium processing only if the H1B petition and H4 application are filed together initially through premium processing.
