Question
my employer revoke my h1b and i am not able to find another employer ,so how many days can i stay here.am i out of status

Answer
Hello,

Your employer must first request a withdrawal. When the USCIS receives documents from your employer, revocation will occur. There is no law that dictates how long you can stay in the USA after being laid off. The date on your I-94 rules the question of "unlawful presence" for purposes of the 3 and 10 year bars. If you still have time on your I-94 then you are not accruing unlawful presence until that date has passed.

Thank you for your attention. Best Regards.
