Question
Hello,

I have a friend who came to the USA five weeks ago as a fiancee. She has just got married. Thus, she is waiting for her marriage certificate. She will receive it within 3 weeks. Can she ask USCIS to extend her visa?

If she applies for adjustment of status, will the presence of her husband be required? If her husband does not want to be present at the AOS interview, what will happen to her?

Thank you for your assistance.

Answer
She does not need to extend her visa. She just had to get married within 90 days. She can file AOS whenever, but the sooner the better. Her husband must show up at interview or the case will be denied and she will risk being placed in removal proceedings.

Regards,

Robert
