Question
I'm an American woman and married my Thai husband in Thailand this year. We filed for his I-130 to move here and it was approved. Now he told me that he was arrested 2 years old in Singapore using a fake passport. Will this arrest prevent him from getting a US Visa. Will this arrest report be discovered during his back ground and FBI checks? Should he disclose his arrest record on the visa forms where it asks about if you were ever arrested?

Answer
He needs to admit the arrest ona ll forms and at interview. He needs to provide a dispostion. It may cause him to have to file a waiver before he gets a visa, but it should be okay. He will not need a waiver if it is his only arrest and the conviction was not a serious one.
