Hello, I am in removal proceedings and my case in scheduled to be heard by the 3rd Circuit in May, 2007.  Recently I recived a letter from USCIS that I have been selected in diversity immigrant program for the 2008 fiscal year.  I cannot leave the country to ask for visa abroad because I am afraid that I won't be able to return.  Can I adjust my status in the US?  Do I have any chance as a person in the removal proceedings to get the green card through the lotery?  Do I have any chance?

Answer
If you have not maintained legal status in thge U.S. since you came in, you are not eligible to adjust. Even if you have maintained status, you would hqave to get your case back to the Immigration Judge from the 3rd circuit and try the adjustment through the Judge.
