Question
Hi Im a model on a valid H1B visa it expires in March 2007 from Britain.
Since 2005 I filed through my American citizen husband (1-485) and its still pending.  We havent had an interview yet BUT incase we dont pass (as im scared) then as an alternative could I extend my H1B Visa and get my green card from that?  If yes when do I have to apply to extend it by?

Answer
You can extend your H-1 if you have not been here for 6 years in H-1 status. You can file anytime after september 2007 to extend. H-1s do not lead to green cards per se. You would need to file separately for that. Think positive about your green card case!
