Hi Arora,

I highly appreciate this service you are providing through allexperts.com. I would like to know your opinion on the following topic.


I am on H1 visa and my wife is on H4 visa. Our passports are stamped with H1 and H4 visas of Previous company. They are valid until May, 2006. I changed my employer in Feb 2004 and got a new H1 approval notice. However, the  new employer did not apply for my wife's H4 transfer. He says since my wife's old H4 is valid until 2006 there is no need to transfer H4. Is this correct as per immigration law? I hear from my friends that H4 also need to be transferred. If H4 also need to be tranferred, how can we do that? What form we can use?

Hi Mohanraj,

Your wife will automatically maintain her H-4 status until May, 2006 since you are maintaining your H-1B status, and this holds true even though you have changed employers.
