Hi. My husband is planning to petition me with the I-130 with in the next month. However if the petition is approved and we are asked to show for the interview, my husband won't be able to make it due to over seas active duty services. What will happen to our petition? Is there a way where my husband does not have to be in the interview?


Answer
Immigration is very flexible with people inthe military. If it gets scheduled for when he is away, if you go in they will likely tell you to let them know when he will be back and they will schedule it for then. They will not approve the case without him.
