Hello,

I have a friend who was sponsored by his US father. Lately, his father died of cancer. Can his mother act as a substitute sponsor to continue I-130 filed by his father whose joint sponsor is his sister?

Answer
She can not be substituted without starting a new case and filing date. However, you can advise Immigration of his passing and request that the petition be revalidated if it was already approved. Then the case can be processed and the sister can be the financial co-sponsor.
