Question

Hi mark

Do arrests that result in dispositon in your favor ( sealed/dismissed ) appear in CIS checks for naturalisation?. Do immigration authorities care about these arrests ?

thanks

Sunny

Answer
Sunny,
The arrest and dismissal may show up in the background check.  Usually cases that are dismissed still appear on criminal history checks unless there is a legal procedure called an expunction.

I have had many clients tell me that their case was expunged or that their case was sealed only to find out later it was not.  Getting arrested and having a case dismissed should not affect your naturalization but you should still include this information on your immigration papers where applicable.

Good Luck
