Immigration Issues/non-profit H1B petition start date, new for-profit H1B petition


My current non-profit H1B petition was filed on 3/9/07, just 5 days before
my EAD expiration date.  I still haven't received the approval yet and
wondered if I can file for another for-profit H1B petition during this period
even though my EAD has expired?  
If I get approved for the first petition, when can I start working?  Do I have to
wait until 10/1/07?  If so, what happens to this period from now until

There are two issues regarding your filing for H-1b for profit company at this time.  One is that your H-1 has not been approved yet.  You are currently on authorized period of stay.  The second is the issue; whether a person with a non-profit H-1 is subject to the cap or not.  If you get approved you may begin working right away for the non-profit.
