Hi,

I am a student on F1 visa.  My employer wants to file for H1 even though there are only 4000 visas left.

I want to go to India from Sept 15 - Oct 5 before joining work.

Question:  If my H1 gets approved when I am in/or before I leave for India, can I come back using my F1 visa, or do I need to have my new H1 visa stamped to come back?

Where did you hear there are 4000 left - Do you have amasters degree from a U.S. university? If you do not have a Masters and are not from Chile or Singapore there are no more H-1s available right now.

If your H-1 gets approved, you will have to get the H-1 visa stamp in order to come back, because your status will be changed as of 10/1/06.
