Question sir,i had signed a non-judicial bond with a company,in which it was mentioned that if i leave the company in less than18mth i will have to pay for all the trainings i will go through.i had absconded from the company in 2mth & in these 2mth for which i had worked they had not provided me any training mentioned in the bond but provided with some absurd training.4mth has passed since & nothing has happened.
my concern is that as i had signed the bond can they do anything like court notice etc?
if any such thing happenes what i need to do?
also,i had left the company in probation period.i.e in the periond when i can leave without any notice.
pls reply,i will be thankful to you
thanks
Answer Hello Rahul Sharma,
Since you have already left the company and it is about 4 months now. You need to await some response from your former employee. The process of the court may only be on the demand that they make under the bond and for which, there should be a notice demanding the amount before proceeding to legal recourse. In the event your former employer proceed legally, then the summons of the court where they take up this case will be sent at your last known address recorded with the company.
It is premature to state the events when there is no issue on hand. The defense in any case is only after we get to know the claim of the other party.
The appointment letter or services agreement is a vital document which you need to read as to the effect of abandoning or leaving the company while in probation period and the effect of the bond and breach amount in probation. In the absence of any contractual obligations being told to me, it may not be viable for me to answer on this issue the consequence of your leaving without notice to your employer.
I hope this suffice your present query,
All the best
