post dated cheques given to person who has sold his company and the pirated software saying he has developed it also took advance from us.did not transfer the share.the lady whom the software belong had file a fri an year back.but still a file a case under 138.pls advise me its a case of cheating.how can he present the case in court.and what is the outcome of such cases.

I am not able to comprehend your version. Can you please make it clear? Have you given the PDC's to someone and purchased a pirated software or otherwise and the involvement of the author of the software filing FIR, whether case under 138 has been filed or not or that you want to make out a case of cheating, kindly make a clear statement so that I can endeavor to answer you query.
