Question
Dear Sir, We are three brothers (two got married)and a un married sister. Father died in '92 by accident, and mother out of sickness in '03. We have two lands and a house with two rented house. At present eldest is looking after the house and property (still in my parents' name). Now we want to divide them. Do all have equal rights or myself (unmarried)and sister has less rights? what are proceders to be done? Thanking you!

Hi casimir,
If your parents have not made any will then all of you will share equally.There is no such procedure as the property will be equally divided. However if other heirs oppose for equal share or denies your share you can file suit in the court for partition of property. However with regards to rented houses it depends on the owner whether to rent it or not and in whose name.
