Subject: Property dispute between my uncle and 3 of his sisters over grand father's property

Question
Hi,
My mother (also her 2 sisters) has disputes over her father's properties with her brother. My grandfather passed away 6 years back. My uncle has refused to share any of my grand father's property with her sister. We suspect that he has also destroyed our grandfather's will.
Please suggest me to find out my grandfather's will. We are not sure if he has registered his will. Can we use RTI for this?
Our grandfather had leased out my mother one land for 99 years. Had he decided to give all his properties to only his son, he wouldn't have leased out land.

Thanks,
Gajendran

Answer
Hi,
First was it your grandfather's self acquired property as if it was an ancestral property then your grandfather will not have power to dispose of property by will and it will be divided equally between 3 sister's and brother. This will be the case if it was his self acquired property and he had not made any will.Try to find out the lawyer who made his will. You can also use RTI.You may also issue a legal notice to your uncle to produce the will if any.
Rgds,
