Dear Sir,
Mrs.Sipra Das was a school teacher and had the job upto 2014.
She died in 2009 and her husband paid all documents of his wife to the  school circle inspector in 2010.
She had also a SBI life insurance nominated with her husbands  name, that  was not matured in her life time.
The insurance is now matured in 2013,but her husband is also dead now and they had no children.
And her husband Mr. Mantu Das had done a registered will for his relative(shali-Mrs.Sukla Dey) in 2011 and it is still not probated for money problem, cause she needs Rs 70,000/- for probating.
Mr. Mantu Das kept her shali as a joint owner(survivorship) of his bank and post office accounts also in 2010.
Now the question唯efore probating  the  registered will-
(1)Does  Mrs.Sukla Dey  now claim the insurance matured amount as a proof of joint owner(survivor)of his accounts ?
(2)Does   Mrs.Sukla Dey  now  claim the amount of Provident Fund amount of her elder sister's to the school service commission as a proof of joint owner(survivorship)of his accounts ?

Please give me a suggestion in details as a well wisher.
Sukmal Dey

If Mr. Mantu Das died after making a WILL,then his properties will devolve upon persons whom he desired should inherit his property after his death. However, WILL does not become effective, unless certified by the court.Technically, it is called "Probate".For the said purpose, one of the beneficiaries have to apply to the court.
In the instant case, neither the Insurance Company nor the RPF will agree to pay any amount to any claimant, unless a certified true copy of the WILL or a Succession Certificate is submitted to them.Since,Mr.Das died after making a WILL, there is no scope to apply for Succession Certificate in the instant case.So far as claim from Bank/Post Office's are concerned,if Mr. M.Das had a joint A/c with Mrs. Shukla Das, then as one of the survivors, she can certainly claim the dues of Mr. Mantu Das. Moreover, upto a certain amount banks now-a-days pay to the legal heirs upon death of the Account-Holder.
Accordingly,it is suggested that please take appropriate actions in the matter in consultation with the School Authorities as well as a lawyer.
