Question
Is it true that in the state of Indiana - if the executor of the estate is not a resident of Indiana - a "co-executor" must be named that IS a resident of the state of Indiana?

Answer
That is not the rule.  Most counties follow the statute that does allow out of state executor.  In Marion county the court now requires a "resident agent" for an estate that has an out of state executor named.  The theory is that the court wants to be able to get hold of some one local in the event something goes wrong.  We have heard that Lake County now does require a local "co-executor" for the same reason though.   JDH
