Question
Can a mother and child move to another state for job and school purposes if the father does not have any current visitation or court assigned visitation. he has not seen the child since she was born. She is now 5 mos. old.

Answer
By Statute the answer is no.  Have the mother give notice to the court that she is moving within 90 days and the court then has the obligation to get him notice of the potential move.  If he does not respond then she can do her thing.  If he does respond she can still probably move under this set of circumstances.  JDH
