Industrial Health and Safety - CA handicapped parkeing rights

Expert: Mike Smith - 11/4/2008

Question
Sorry to bother you with this Mr. Smith but I didn't know where else to start.  I'm a working disabled veteran with a handicapped parking placard.  There is one space across from my office that is reserved for handicap parking. 90% of the time when I'm not parked there,  non-handicapped vehicles are parked in the space.  The problem is this, I have been told by my boss that even though I have a placard, I am no longer allowed to park in the handicap parking because a woman complained that I was parked there and she wanted to be able to park there instead!  What are my rights?  Can my boss demand this, and do I have to put up with this kind of harassment from persons not patrons of the business?  I can't afford to risk my job or my health.  This woman did this same thing at the other address where we were located!

Answer
CharaLeigh,
Sorry this took so long. I was a candidate in this election and it took much more time than I thought.
Answer; Does this woman have a Handicap parking permit?
If Yes, you may just need to beat her to the parking spot.
If no, then you need to contact your local police dept, and have them enforce the law. Please remember that it is the law, and not your employer who decides where you can park. You do not need to tell your employer you called the police.
A second choice is to drop a line to the American Disability Association.
Please remember that it is the law not you who makes these rules. If your employer retaliates he will need to deal with the ADA.
These people are ruthless once they receive a complaint.
Good luck and let me know how it turns out.
Mike
