Subject: Auto insurance company is threatening me with court

Question
In April of this year I was backing out of my driveway and I bumped into a car that was parked on the road in front of the house across the street. He was not parked in their driveway, he was parked in the middle of the road.I live at the end of a cul-de-sac. He watched me back into him, claiming that he thought I saw him.  His wife's insurance company is now threatening me with legal action, saying that my bank accounts are going to be garnished if I don't contact them to make payments. Is this legal? We filed a police report and the officer didn't give me a ticket because I was pulling out of my driveway. What should I do?

Answer
Hi Tara-
You will need to make arrangements to pay for the damage, or turn it into your insurance company if you have auto insurance.  You are considered to be at fault, because going in reverse is against the natural motion of the vehicle, and requires more due care to avoid objects than going forward.  Hope this helps. :) Denise
