Question QUESTION: Hello,
I have been battling with Fidelity National on flood claim for 3 years and finally agreed to a number, and fidelity submitted to NFIP to approve. NFIP approved and now Fidelity is asking for the owners to sign a release before they will release the checks. Isnt that against the law to hold the payment hostage until a release if signed.

I'm sorry to hear that you had such an extended problem getting your claim settled.
A 'release of all claims' is normal and standard on all types of insurance claims before the check is released. This is the one document that allows the insurance company to fully close the claim with the knowledge that there will never be any additional demands or litigation.

thanks for your response, but in Florida it is against the law. I was just curious if NFIP has to abide by the same standards. I should have been more clear.
Answer Hi David,
I have no knowledge that the law in any state forbids the insurance company from getting a release.
If such a law exists in Florida, the fact the flood insurance is a Federally Subsidized program may waive that rule.
You can always contact the state department of insurance for a clarification of question of a release.
