AboutRichard Expertise I have been the no-fault insurance administrator and arbitration specialist for 18 years working for a plaintiffs` law firm. Question I droe up to California to visit my family from Texas and while I was on my vacation a car hit me. Now the insurance is refusing to pay me because my car is not registered in California. Is this legal?
Answer Hi Issy, are you asking about your insurance company or the insurance company which insures the other vehicle. If it is the other person's insurance company then you will have to sue the other driver. If it is your own insurance company then you will have to sue your own insurance company for "breach of insurance policy-failure to pay insurance claim". Check with your own insurance policy first to see if there are any exclusions regarding driving in any othe state. I doubt there are but you never know.
