Question
*Hi, I was wondering if you could help me with a question.  My husband and I came home a while ago and found a note taped to our door. This is what it says....
"Hello, a branch from your tree fell on top of my truck and dented it during the storm last night. Contact me." And he left his name and number. (this is our neighbor) We were wondering if we were liable for this, and what to say when we do call him? Thank you for your time! Any help at all is very appreciated. Thanks!

Answer
Hi Kelly-
Such things are considered to be an Act of God, and are covered under your neighbor's Comprehensive coverage on his auto policy.  Unless the whole tree was rotted, and you had been warned that it should have been taken down and failed to do so, you aren't considered to be negligent for a branch coming down in a storm, nor will your Homeowners insurance pay for his damage.   Hope this helps. :) Denise

I can provide input if you will give me a "one paragraph what`s the story", however depending on the situation, do note that as policy forms and endorsements vary by the state, the information may be general and educational in nature.
