Question I was involved in a car accident back in Feb. and had no insurance. I recently was contacted by a law firm that represents the other party's insurance co. They say that I owe 8,000.00 in damages for the other persons car. I told the that the best I could do was $100.00 a month payments ( me and my husband neither one make very much and we have 3 kids, we can barely afford food as it is.) Anyway, they said that I would be welcome to make payments and any payments that I did make would of course come off the total balance, but that my making payments would not keep them from filing a lawsuit against me, and that my license would also be suspended. Can they take my license even if I am making payments? And if so, for how long? If my license is taken away then I can't get to work which means less income, and I wouldn't be able to make payments to them. My husband lost his license years ago, and I give him rides back and forth. I have a perfect driving record other than this, not even a speeding ticket.

I'm not an attorney, and state laws do differ regarding causing damages in accident, and not having insurance or the means to compensate the party that was damaged. If they take it to court, which they likely will to get a judgment against you so that you will pay what you owe, it is very possible that the judge will have your license suspended. You will probably be able to get an occupational license allowing you to travel to work. You may want to consult with an attorney to let you know your options in the state you reside in.
