Question
My son and I were on our way home tonite when a large portion of an old oak tree broke off and fell on my truck at the exact moment we were driving past it. there is significant damage to my truck, no personal injury. the highway patrol said the tree was the property of the county. what are the chances that the county will help with the cost of repair, at least the deductible, and is that something my insurance company would pursue or would i? the patrol officer said it appeared the trees were in poor condition, and we recently had 108 degree heat. i know accidents happen, i have insurance. just curious if there would be any assistance with my deductible.

Hi Stephanie-
You can ask, but I doubt that the county will respond.  You would have to be able to prove that the tree was unsafe, dead, and a hazard to traffic previously, and should have been removed.  A arborist would be an expert, but it would likely cost you as much as your deductible to find out whether there was in fact any real negligence on the part of the county.  Sorry I can't be of more help. :) Denise
