Insurance Law - Stolen Van

Question
My van was stolen 8 weeks ago. The insurance company have messed about delaying things. I was given a valuation for the vehicle 2 weeks into claim, this I agreed with. I was asked to pay a shortfall to Finance company which I did. They told me they would pay the rest to finance company straight away.  2 Weeks later I am telephone by police to say they have recovered my van in Yorkshire, it was being driven by a gypsy.  I call insurance company to notify them. They tell me that the van still belongs to me as they did not honor their promise and still had not paid the finance company.  Therefore they have told me that if the van is repairable I have to have it back. My van has been driven by gypsies for 8 weeks, god know what state it is in. I feel that if the insurance company have my keys and log book, surely the van now belongs to them?

Answer
Hi Antony-
I can't say for certain how such things work in Britain, but in the US, if the claim hadn't been completely settled, then the vehicle, if recovered, is still yours.  You can put in a claim for any damage that occurred, but it is still owned by you.  Sorry I can't be of more help. :) Denise
