Insurance Law - STATUE REGUARDING ROOF REPLACEMENT IN KY

Question I have storm damage. The insurance adjuster came to my home in Feb. 09 and looked at the roof and said I had 3 "tabs" loose. At most $250 damage. I disagreed with him and had 3 contractors come look at the roof, they all said I had storm damage and gave me estimates. I submitted the estimates and was denied. In September I had 2 porches built. (Front and Back) When the contractor "tied" in the roof for the porch to the house, he noticed extensive damage under the shingles as well. After playing "phone tag" with the insurance adjuster, he finally came and met with the contractor for the porches and after a long discussion, agreed to replace the front. MY QUESTION....what is the Kentucky Statue that states my roof has to be replaced with "like and kind." IT ALL HAS TO MATCH, I believe is the meaning. The back part of the roof is damaged as well, but the adjuster will not agree to replacing it. Only the front. Can you help me with finding the KY Statue to show to him? I mentioned it to him and he said it only applies to patching....well, I believe replacing just the front is a BIG PATCH JOB! Any help will be much appreciated.

I'm not an attorney, nor from Kentucky, so I can't help you with the exact statute question. You may though, want to contact your state's insurance department. You may want to consider making a written complaint, and having the state investigate, since it appears from your statement that there is also damage to the back side of the roof. Whether that damage came from the storm damage, or from other issues, such as the age of the roof, lack of maintenance, ect. The fact is you provided documentation from 3 contractors who states there was more damage. That may be your best bet at this point. Hope this helps. :) Denise
