Insurance Law - Medicaid fraud/menatl health/false records

Expert: Richard - 8/27/2009

Question
QUESTION: They damaged me but I was too sick to file a claim for malpractice or the privacy of medical information violation, or the Medicaid fraud. I think I need to get my records. How do I do that, because the parties at the mental health center was making out I was endangering them and turned that in the their D.A. buddy so now I can't really even call and ask them and they probably had the DA take them, because I think they wanted to frame me with a false charge, then no one would have known about their Medicaid fraud. I will try to clarify things again after I rest. Thank you.

ANSWER: Hi Robert, there seem to be too many agencies against you for you to do any of this on your own.  I suggest that you contact an Attorney who handles malpractice cases of this nature and make an appointment to see him or her.  If you cannot find anyone to take on your case then try Legal Aid.  Somehow someone must have received a granting of Power of Attorney or Guardianship from some Surrogates Court and an Attorney will be needed to revoke it legally.

---------- FOLLOW-UP ----------

QUESTION: I thought they probably made someone a power of attorney with my signature copied on any court documents or medical records they needed to get everything hush-hushed involving the whole affair. What is  possible source for finding such attorneys? This has a lot of ramifications because I will have a disability case review at Social Security at some time.

Answer
Hi again Robert, you can search for a Malpractice Attorney in your area on-line or in the newspaper advertising.  There is most likely also a listing for Legal Aid Society as well.  You can also call your local Bar Association and they can refer you to one.  Best of luck in this matter.
