In mid Feb 13 HO premium was due.Sent to lender who has the escrow for taxes and insurance.Mar 18 2013 windstorm hit home .Ins company sent adjuster and determined approx $32000. damage. Then next day they notified premium had not been paid by lender and  they were not liable. In speaking with lender they are refusing to pay.In your opinion is a lawsuit next step?

You most assuredly have grounds for a lawsuit against the lender if your mortgage was set up for them to pay the premiums and they did not.

Generally, those types of policies are called "forced place" and there may be a large number of properties under that same policy. They are required to provide a listing of properties to the Carrier for each home covered.

It may have been an accounting oversight on their part but if you can prove you paid the proper premium to them, then they are the ones on the hook.

What did the letter from the lender say when they refused to pay?

After leaving Allstate, I specialized in handling losses associated with major catastrophes through-out the country. (Hurricanes Isabel, Charlie, Wilma, Katrina, Ike, etc., hail storms, floods.) I am currently retained as an expert by multiple insurance defense firms in Texas for issues in litigation. I am also a certified Umpire for formal appraisals.
