Hello there good morning, I have an idea for a beverage that I would like to see produced by one of the major companies as an aerated beverage.I was reading up on patents and I see a lot of nformation about gadgets but nothing about beverages.Can an idea beverage itsef be tatented?

Hello roger,

A drink recipe cannot be patented.  Please check out these links:  http://en.allexperts.com/sitesearch.htm?terms=patent+drink&sdn=www

However you can copyright the recipe and trademark the name.  The drink recipe's PROCESS of making the drink can be patented, you can also include the recipe in this patent as well.  You will also have to get FDA approval.  Go here for more information: http://www.fda.gov/Food/default.htm
